Terms and Conditions
1. Acceptance of Terms
By using the brumacollective.com site and placing an order, you accept these Terms and Conditions and our Privacy Notice. If you disagree with any of these terms, please refrain from using the site or making purchases.
2. Who We Are
Bruma Collective is a Costa Rican online store specialising in premium Costa Rican memorabilia. We operate from Costa Rica under its laws.

3. Products and Availability
We make reasonable efforts to display colours, materials, and dimensions accurately, but screens may vary. Inventory availability is confirmed at the moment the order is placed; if an item sells out between display and confirmation, we will notify you and refund any difference within 7 business days.
Prices are shown with the 13% IVA (VAT) included. The default currency is Costa Rican colones (CRC). If a USD conversion is shown, it is referential only; the actual charge is always in colones via SINPE Móvil at the prevailing rate.
4. Ordering Process
- Add products to the cart and proceed to checkout.
- Enter contact details and delivery address or pickup location.
- Accept the data-processing consent (checkbox at the end of the form).
- Receive SINPE Móvil payment instructions and an order code.
- Transfer the amount from your bank to the indicated SINPE number, and send us the receipt.
- Once the receipt is validated, we confirm the order and proceed with shipping.
The contract is formed when we manually validate the SINPE receipt and send the confirmation email. Until then, the order remains pending and inventory is temporarily reserved for 30 minutes; after that window without a valid receipt, the reservation is automatically released.
5. Payments
The only accepted payment method at this stage is SINPE Móvil. We do not process credit or debit cards or other electronic methods. We will never ask for your full bank-account number or credentials: you initiate the SINPE transfer yourself from your banking app, and we only receive the receipt.
No payment-method surcharges apply.
6. Shipping and Delivery
- Home delivery inside Costa Rica: via Correos de Costa Rica or the carrier indicated at checkout. Estimated times are 3 to 7 business days, not guaranteed; they may extend during peak seasons.
- In-person pickup: available where indicated. Pickups must occur within 14 days of the availability notice; after that, the order may be cancelled and refunded.
- International shipping: not currently offered, except by direct email coordination.
Shipping cost is calculated by destination and displayed before order confirmation. Once dispatched, we will provide a tracking number where the carrier supports it.
7. Returns, Exchanges, and Refunds
We honour your right of withdrawal under Article 40 of Costa Rica's Consumer Protection Law (No. 7472) for distance purchases: you have 8 business days from receipt to withdraw without penalty and request a refund, provided the product is in its original, unused condition.
- How to request: email orders@brumacollective.com with the order code and reason.
- Who bears costs: if the return is due to withdrawal, the buyer covers return shipping; if it is due to a defect or our error, we cover all costs.
- Refunds: issued via the same SINPE channel within 7 business days of receiving and verifying the returned item.
Custom or made-to-order items do not admit withdrawal once production has started, unless there is a clear defect or a mismatch with what was agreed.
8. Warranty
All products carry the minimum statutory warranty established by Law 7472. If a product shows a manufacturing defect, contact us within the applicable warranty period and we will arrange repair, replacement, or refund as appropriate.
9. Acceptable Use
You agree to:
- Provide truthful information during checkout.
- Not attempt to access restricted areas, tamper with the site's operation, or run mass automated actions (scraping, inventory sniping, etc.).
- Not use the site for unlawful purposes.
We reserve the right to cancel orders, restrict access, or take other reasonable measures against abusive or fraudulent conduct.
10. Intellectual Property
All site content — text, photography, trademarks, logos, designs, and code — is the property of Bruma Collective or of third parties who have licensed its use. Reproduction, distribution, or modification is not allowed without express authorisation. Physical products purchased may be used personally but do not grant commercial reproduction rights over their design.
11. Limitation of Liability
To the extent permitted by law, Bruma Collective is not liable for indirect damages, lost profits, or consequential losses arising from use of the site, unless attributable to wilful misconduct or gross negligence. Our total liability for any given order is limited to the amount actually paid for that order.
12. Data Protection
Processing of your personal data is governed by the Privacy Notice, which is an integral part of these Terms.
13. Dispute Resolution
Any dispute arising from these Terms will be resolved:
- First, by direct dialogue via orders@brumacollective.com.
- Failing agreement, through the administrative route before the Comisión Nacional del Consumidor, or, for data-protection matters, the PRODHAB.
- Ultimately, before the courts of Costa Rica, seated in San José.
These Terms are governed by Costa Rican law.
14. Changes
We may update these Terms to reflect legal or operational changes. Each version is identified as vN-YYYY-MM-DD. The version applicable to your order is the one published at the moment you ticked the consent box; it is stored alongside the order for reference.
